I want to move out of Illinois . I do not have a court agreement with the father but his name is on the Birth Certificate.He does not pay child support and there are no legal arrangements. He has contact with our son when he wants. What do I need to do so he can't keep me here?I am planning to stay with family work and finish school. What do I need to do so he can't take me to court the day before I leave? Please help. :confused: :(

I don't know the law there but I would think that he has no legal ground to stand on. Maybe he could go to court and try to get some ground, but he doesn't appear be that kind of a gung-ho father.
Would he go to this trouble to just spite you? As far as child support, I didn't think he had a choice. Can't you get his wages garnished ? It is his responsibility to help provide for any child he creates.

Why is there no legal child custody agreement, in fact without one, there is nohing to stop him from merely getting his child and keeping them, his name is on the birth certificate and there is no custody order in place.

There is nothing to stop him from filing short of you going to court and getting court orders in place, and the court giving you permission to move.

If you guys aren't married, there's no court order custody agreement, and no open court case pending... LEAVE!! Don't tell him your leaving... just go... I relocated from Florida to ny and when we split up my son father petitioned me to go to court days before I was going to leave back home. Don't wait just go... Because of what he did Im stuck here now in NY and I don't have any family here. Its very hard to relocate with the child and the court is going to look at the "best interest of the child" and if he petitions your first before you leave... then your going to be stuck there until the court makes up their mind.

Just go... trust me. Once you are back home for 6 months you'll be a resident of that state then you can petition him for visitations.
