I married in the State of Virginia, on 1 December 2008. My question is: If I divorce my husband on the grounds of drinking and abuse, could he sue me for alimony? We bought nothing together, I owned everything before we married. He did not have a job, but now he does.

I think you mean dec 07 ? If that is the case then if you were to go separate ways at this point in time you may not need a divorce. In a lot of states you can get an annulment if the marriage is under 6 months otherwise your going to have to go through divorce. If alimony were to be sought it would only be fore a very limited time ( rule of thumb ) alimony can't last longer then the marriage. Ask your local bar for a lawyer in your area they usually give a reduced fee for consultation.

He would have to have been dependent upon your income to claim alimony, and that is not likely in such a short marriage.

Dec. 1, 2008? Do you perhaps mean Dec. 1, 2007? In that case you've only been married three months so he wouldn't be entitled to very much alimony if any.

Can he ask for it, of course he can ask for it, will a judge give it to him, most likely not, but then who knows what jduges will or can do.
But my best opinoin is no, the judge would not award any.
