Hi,
During 2004 , I was in F-1 for 9 months and switched to H1B for the rest. And I filed 1040NREZ and got my tax refunds. My employer has deducted ss and medicare. I didn't know that there is no need to pay for ss and medicare if it is dual status year. I came to know this just today... Is there anyway I can amend and file the form 843 and get the ss/medicare I paid during 2004 back? Or it is just gone?

There is no need to amend your 2004 tax return. The filing of Form 843 is a separate transaction. Download IRS Pub 519 from www.irs.gov and refer to page 46 for the procedures.

I have a question...
Do the ss and medicare taxes we get back need to be taxed?
Are they taxable income?

Falcon 1 has asked another question on this topic.. do the ss and medicare taxes I get back need to be taxed? Does it need to be reported this period as I have not got that back and no guaranteee I will get it back... Please throw some lights on this.. I would be deeply indebted...

If you get the Social Security and Medicare taxes back in a refund, the refund is NOT taxable.
