View Full Version : Supporting docs for form 1116 while tax return

Hi,
I came to NJ,US on May,2007 on H1 and my wife joined on Nov,2007 on H4. Since then we are staying in NJ only.
After looking into other answers about filing returns, I think I am eligible for Resident Alien
And filing for married joint return.

However, since I have foreign income for the first 4 months, (about 10000$) I am submitting form 1116. Please clarify me the following questions on 1116.

1) What are the supporting documents do I have to attach along with the 1116.
Is the supporting documents like pay stubs of foreign income is required while filing the return?
2) If I am applying for TIN number(using W7) for my wife while filing federal return,
Then I cannot file my NJ state return until I get my wife's TIN.
Since getting the TIN might take 4-6 weeks, is the NJ state return will be automatically extended in this case?
Or any procedure is needed ?

Please help me on the above questions.

No supporting documents need to be attached to Form 1116. However, if you are audited, you will need to be able to show the amount of foreign income and foreign taxes paid.

You should extend your NJ tax return.
