Hi

I have come to US on H1B with my wife who is on H4 in April 2007 and went back to India in the end of June 2007. I came back to US in September 2007 along with my wife. I have received W2 form from my employer. I have few doubts regarding the Tax filing procedure. I need clarifications on some of the points, As I'm filing for the first time and I'm not very much acquainted with the Tax filing procedures.

1) I will be filing as a Non - Resident Alien for the year 2007 due to failing in substantial
Presence test. (please confirm this)(I have stayed around 176 days in 2007)

2) Am I eligible to receive any deductions if claiming my wife as my dependent? (can I file jointly when I'm filing as a Non - Resident alien)

3) Are there any other deductions, if I'm filing as an Non - Resident alien ?

You can file jointly with your wife and you BOTH choose to be treated as resident aliens for ALL of 2007. This will likely be the best option tax-wise.
