My fiancé is going back to court because of his ex wife she's holding in contempt of child support also insurance on his child and marital debt. He's worried about going to jail. He's been paying what he could first of al let me state that after there divorce papers were signed she moved all the way across the country and he hasn't seen his child in a year. When the divorce was final it stated that he was making a certain amount and at the time he was now he's not he lost that job and he's been struggling to try and pay her what he could. He had a really bad accident in October and he went out on disability he lost insurance on his child because of the disability he asked her to hold insurance on him until he got released to go back to work and now she's taking him back to court for the fact the divorce paper's stated that he was to help pay for any medical expenses she's never once called him and said I need this amount of money for this bill on our child, but she's fixing to take him to court over this. I was wondering how does the Georgia Law work as far as this situation goes because he's worried about going to jail now and he will loose his job and everything and will not be able to pay her now. Only thing he wants out of this is to see his child like a normal parent would. He's willing to make things better for what she wants but he just wants to see his child. Also let me add the fact that before we met he was getting to see his child unsupervised. This was before she left the state. When she found out he was dating someone else and she wanted him back she said that he needed to be supervised to see his own child. I just don't know I would just like some kind of input on what can be done and what might happen as far as the court goes?

OK.. not sure where to start. First off its hard to say anything without knowing what the papers say. 1) he should have already acted to keep his child near, it might be too late now. He needs to bring all proof and records with him of any payments etc he has actually made. He needs to bring accident reports etc so he can back up anything he says. The judge might let him off with a warning and place the unpaid amount in arrears and monitor the case to make sure its being paid from now on. He needs to ask for a modification if he wants to pay a different amout ( separate issue ) Also if he wants time with his child then he has to act on it.. develop a plan on how to see the child since the child is across the U.S. Depending on the age of the child they may be able to fly or not. If not then he will have to make arrangements to go there. As far as the insurance deductibles.. he's not a mind reader so either she has to send him something or she won't get paid. He can ask that correspondence be done in writing and by registered mail so both parties acknowlage getting it. At this point its really hard to say what's going to happen because no one can actually predict court outcome but if he's honest and can pay from now on he might not have to go to jail. He does have a lawyer right?? If not he needs one. Contempt citation is nothing to fool with.
