My fiancé owns a home in the state of New York. The mortgage is in his name only. His brother lives in this home and pays rent. His brother's wife has put a lien on the home for $25,000.00 which is part of the divorce agreement with his brother and once my fiancé sells the home she will get $25,000.00.

My question is: If the home is my fiance's name only how can his brothers wife put a lien on property that she does not own as well his brother not owning the property.

Is this legal? Can his now ex-sisterinlaw put lien on his property?

Are you sure there is a lien on it. Since he's a renter, then she has not right to put a lien on it.

did the one brother ( who is the renter) ever own part of the home, did he trasfer ownership to "hide" his property?? If so then the lien may have some value.

If there is a lien ( and not sure how they were able to do one without a court order) but all the owners need to do, is do a legal action to have this removed, making the lady show proof it is a valud lien.
