Hello, my boyfriend was out of work when I started a relationship with him, I paid of his debts, fines, supplied him with food, bought his clothes got him his passport, driving license, paid his mobile phone etc..,. got him his well paid job, now basically he has left me £6000 in debt,. he turned out to be a violent abuser,. we have now split up,. all the debt is in my name, I can not prove its his, I have asked him to help , he just tells me to go away, or tries to bribe me by saying be nice to me and I might help... I am registered disabled with a mortgage,. I can not afford to pay this debt... the interest I am being charged is just increasing the debt. I am at my wits end is there anything I can do,. he lost a previous job through theft,. he now lives back with his mother which is next door... I am taking anti depressants, is there anything I can do? Lainie

Unfortunately if you cannot prove any of this was a loan - and it sounds like the understanding was these were gifts from the beginning - there is nothing you can do.

I don't know if bankruptcy would be an option for you.

On a personal note I would stay far, far away from him before he victimizes you again.

Hi thank you for your answer, just would like to add that he did promise he would pay back his debt when he found work,. of course it wasn't in writing,. but I do have texts on my phone saying he would help with the debt... lainie

Well, if the small claims courts are as cheap as they are here, I'd sure sue him. What's another $50? Those text's might be enough to win.

That certainly changes things. And, yes, I would go into small claims court with your proof.

Hello again, lainie:

I'm not sure if we stressed the law in this matter enough.

In our common law, which we learned from you, it's accepted that people don't pay for gifts. They just don't. Additionally, people don't ask for their gifts to be repaid.

So, if it can be shown that he made ANY payments, or acknowledged the debt in any way by saying he would help repay it, that IS solid evidence that the money was a loan. If you have texts saying anything like the above, you should win hands down, no questions asked.
