My name is on my sons birth certificate but he does not have my last name... how can I change his last name to mine?. is there any fees?. can I request a form on line?. I live in nyc by the way.. I will gladly appreciate it.. thanx

You will have to get consent of the biological father before you will be allowed to change the child's last name.

You will have to check with the court in the county you live in as far as costs, in Ohio it's $133.

Oh... haha... sorry, usually it is women asking how to change their child's name.

Yes, you can file in court and petition to change the child's last name to yours, or at the very least have your last name added, hyphenating the current last name.

The judge will then decide what is in the best interest of the child. If the child is older, thus having made a personal relationship with the current last name (knowing it, using it in school etc) the judge may decide that adding your last name would only confuse the child. You would have a better chance if the child was young.

I would suggest calling around and getting a free consultation with an attorney and get their advice.
