Hi,

I am Rajkumar.

I need to file for the tax returns for me and my dependents like Wife and Kid.

The problem is I have first entered US in 2006
01- August 03-2006 and I left Us on August 09-2006
02- Again I came back to US in March 23-2007 and I left on April30-2007
For these two times I came alone.
03- On Sep 07-2007 I came to US with my wife and Kid ( Son of 3 yrs old now)

I have two W2 forms for which I need to fill the tax returns

01- for 2006 ( 6 days)
02- for 2007 ( 154 days)

Please guide me which are the things which I need to do for this and how should I get the benefit.

I assume you were on either a "L" or a "H" work visa.

For 2006, file Form 1040NR-EZ. Unless you are exceptionally well-paid, you will owe NO taxes for 2006 and get all of the income taxes (state and federal) back. Note that you probably have no LEGAL obligation to file due to the low income level for 2006.

For 2007, you can file jointly with your wife and claim your child as a dependent if you will be in the U.S. on or later than 23 Maty 2008, which is the earliest you can file jointly with your wife.

You will need to submit Form W-7 with the return to get ITINs for your wife and child.
