Hello, I have 4 children, and was a single parent with my first child she is 15 now. When I met my husband now of 9 years we had our 2nd child before getting married. We chose to give her my maiden name which is also my 1st child's last name. After she was born in June we decided in Dec to get married since we were expecting our 2nd child Noah who has the married last name, and so on with our 3rd... To make a long story short We are moving to a new area and Olivia wants to change her last name, because they will be attending a new school and her name is different from Noah and Rebecca's. What is the procedure. Kim

You must file in the county you live in now, or where you will be setting up residence. You will need to file a petition to change the name of your child.

So are you talking about the child you had with your ex, or your first child you had with your husband?
If it is the child you had with your husband, you will just have to file a name change in court. There is usually a fee (for example, in Ohio it is $133).
If it is the child from your previous relationship, you will need to have the consent from the biological father (unless your husband adopted her).
