View Full Version : Want to file tax returns (working in NYC and a resident of NJ)

Hi ,
I started working in NY from Nov 19 2007. Now I heard that I'll get back all my tax I paid from Nov19th to Dec31st 2007.

I'm filing as a married-joint. My wife is a dependent on me.
When I tried to file through IRS Tax Preparation & E-File Tax Extension Forms Online - U.S. TaxCenter (http://www.irs.com), I gave my work location as NY and a resident of NJ.

After I filled all requisites, it showed me 2 returns
1)Refund you will receive from IRS
2)Refund you receive from New Jersey

Now the first return includes Federal & Tax

My question is is this the correct way... or I need to file 3rd return for NY also like 'Refund you receive from NY'? (I'm not sure if the 1st point IRS includes NY also)?

I appreciate the guidance on this.

You should complete a non-resident income tax form for NY state - this will determine your tax liability for NY. Then complete a resident income tax form for NJ - it includes a line where you enter how much tax you paid to NY, which they allow you to take off as a credit. This will most likely result in you owing NJ nothing, because the tax rates in NY are higher than the rates in NJ. So, if your employer withheld NJ tax from your paycheck, you should indeed get a refund from NJ. Whether you owe anything to NY depends on how much your employer withheld for NY state taxes.
