Hi guys.. what does it mean to enter into plea bargain -does it mean plead guilty or not plead guilty... thank u

Usually it means pleading guilty to a lesser charge.

U can make a deal with d prosecution lawyers to enter a plea bargain by pleading guilty. U then accept a lighter sentence (i.e. less punishment)

Do not confuse a plea bargain with a no contest plea.
Plea bargain means you are guilty, and you are seeking a
Reduced sentence, with no trial.

Hi scottgem ,so does entering a diversion prog which does not involve to plead guilty means entering into plea bargain... kindly advice thanku

Generally, a plea bargain means you plead guilty to a lesser offense than what you were originally charged with, in return for a lighter sentence than what you would receive if convicted of the original offense.

And yes, basically a pre trial diversion program, you are in effect saying I am guilty ( but not doing a official plea in court) or at least you are saying, that there is enough evidence to convict so I am taking a deal)
Because of course if you were not guilty and they could not prove you guilty you would not accept a program but go to trial??
The issue with the pretrial, is it gives you the ability to not have a conviction on your record. It will show up on NCIC for federal security background checks or if you want to go to work for a police department.
So there will be a record of this, for some uses.
What is the issue with what it is called?? It is called a plea bargain because there just is not another term to use for it, normally a plea bargin does require a actual plea, and you are shown guility,
So I guess by pure meaning this is not really a plea bargain, but just a pretrial division program, but the term plea bargain is just used for it, since it is done the same way, they make an offer and you accept.
Why do you care if it is, or is not called something,?
