I work part time remotely from a company in LA and worked the past two years helping them out over here in Texas. 2006 they did not submit a 1099 to me and the other day I was doing my 2007 taxes and realized that I have a lot of mileage use because of this job and need to write it off but can't because I don't have a 1099. So I called them and they said they are sending me a 1099. Is there a deadline for the 1099? I am ready to submit my taxes but am held up. It may be late February or Early March before I see a 1099. Do I have to wait or just tell them to ignore the 1099 like 2006

It seems like since you called them -- you have obligated yourself to wait for the form...

Probably isn't what you wanted to hear -- if you hadn't phoned it would have been a tossup

If you have accurate records of what they paid you, you don't need the actual 1099 for complete your return.

Are you saying that if I had not called and them I could submit my taxes without penalty? Or having to redo?

A 1099 is used to report income to the govt and inform you of what was reported. So if you know what you earned you don't need the forms.
