I am chiniese and hold chinese passport.

I arrived at South Dakota State University Sept 12, 2007 from Shanghai of China. I am a Postdoctoral fellow and hold a H1B.

I want to know:
1) May I except FIT or State Tax for 2007 and 2008?
2) If I can except the tax, how long does the exception last? One year or 3 years?
3) Which kind of documents must I prepare for applying this exception?
4) If I have been charged tax, how could I take back the money?

1 -3) Negative; the H-1B visa is a WORK visa; you are liable for all the taxes that a U.S. citizen pays.

4) File a tax return. For 2007, you should file as a non-resident alien, filing Form 1040NR so you can claim the moving expenses from China to South Dakota.

The 2007 return covers only period up to Dec 31, 2007. So with personal exemption of $3,400 and moving expenses deduction, you will have small taxable income.
