View Full Version : Can my disability be taken by credit card company

I had a credit card and became disabled and was unable to continue the payments. I tried sending them $50 a month. This was in 2005. They were not satisfied with this and I just stopped making the payments. Then today 1-29-08 I received a letter in the mail stating that I was being sued for the total amount plus fees. Then, later that afternoon I was served paper via a sheriff.

I am scared to death. I live in section 8 disabled apartment. I receive disability. I am afraid that they are going to take my disability or put me in jail. I don't know what to do or what they can do to me.

You will not go to jail and the plaintiff cannot get your disability funds.

Hi bethster - I am going through the same nightmare. I understand disability funds (SSI) and retirement funds are exempt from attachment. Please don't ignore the summons - prepare an answer - there are a ton of samples and wonderful suggestions on this site from awesome people. I am in the process of working on mine - so if you need any pointers, let me know. Hang in there, you won't go to jail. Lets fight these scum sucking debt collectors and attorneys, OK?
