Hi- I am working on H1B since Dec 06. I was on F1 (OPT) before that.

I was in US for whole 2007, for 352 days in 2006, and for 341 days in 2005. Based on these numbers, I believe I will file taxes as a resident this yr. Can anyone please confirm this?

Yesterday, I got a form 1099 G with my information about my refund from state tax department. I do not have any clue what is that for. I believe that was the refund I got from the state tax department last yr. Can anyone please explain me more about 1099 G? How that will effect my tax preparation for this season?

Yes, you will file as a resident alien for 2007, probably filing Form 1040EZ, but maybe 1040A or 1040.

For some people, state tax refunds are taxable income. If you filed for Form 1040NR-EZ for 2006, you are NOT one of those people.

If you filed Form 1040NR, your state tax refund MAY be taxable income to you. I wold have to see your 2006 tax return to be sure, though.

Thanks for your reply. I filed 1040NR for 2006. How can I make sure that my state tax refund is not taxable?

If you deducted state incomes taxes on the Form 1040NR, then it is likely that the refund IS taxable income.

I was in US for whole 2008, and half of 2007 I paid state tax in Hawaii when I worked on a cruise ship for 1/2 a year.2006/2007

Yesterday, I got a form 1099 G with my information about my refund from state tax department. I do not have any clue what is that for. I believe that was the refund I got from the state tax department last yr. Can anyone please explain me more about 1099 G? How that will effect my tax preparation for this season? If I don't plan to do my taxes.

If you itemized on your 2007 federal income tax return, you claimed the withheld Hawaii state income tax as a deduction.

That being the case, the refund of the Hawaii tax is considered taxable income for 2008, and needs to be reported on yor 2008 Form 1040 on Line #10,

If you did NOT itemize on your federal tax return for 2007, you can ignore the Form 1099-G from Hawaii.
