View Full Version : How do I put a lien on realestate

We put a deposit down on a house, the realstate office gave the money to the title company and they put it in a escrow account. The bank that owns the house could not get a clear title on the house so we told them we did not want to purchase any more. We had to sing a form so they would sing the same form so the title company could release the deposit back to us. They have not faxed back the form in over 3 weeks. Can we put a lien on the house until they release the deposit back to us?

No unfortunately a lien is a tool that would not help your situation. A purchaser of a home will pay an amount to secure a 'clear title' which allows the new owner to feel confident that there are not any outstanding debts, or 'liens', that are still placed against the property. In your situation, your beef is with the title company. It is a potential legal issue but I would recommend actually going to the title company with your paperwork and talk to the person that heads the company. A title company really doesn't want that kind of legal issue and they almost always comply as long as the paperwork that you have indicates that you are owed the money.
