View Full Version : NY or NJ tax resident

I am currently filed as a NJ resident. My billing address is there, my bank is there, my insurance is paid there. It is all filed under my parents current address. I own my own business which was filled for taxes last year under that address in NJ.

I recently started renting a place in NY and have taken a second job here where I have been paying NY taxes through my employer.

My question is if I can still file as a NJ resident even though I spend my time in NY. Being an internet business there are no papers to say I do business here my expenses are still filed under a credit card with the NJ address and the companies I work for still have my NJ address on their W2 forms .

And what exactly do I do in regards to the taxes I have paid in NY. I am going to see a CPA in February, but my NY employer has begun filling her taxes and she must file in NY so I don't know if it matters what address she puts down for me (the NJ or the NY) and I am hoping to get a little guidance to rest my mind until I see the CPA.

If you run the business in NJ, you OWE NJ taxes. Just make sure you do not put the NJ business income on your NY tax return UNLESS you really live in NY, in which case ALL INCOME goes on the NY tax return.

You need to decide in WHICH state you live. If you live in BOTH, then you file part-year returns for BOTH states.
