We were never married but I want to get full custody or at least some type of papers signed stating he has to give her back after a visit. We haven't been to court for anything. There are at least two possibilities: petition to legitimate child (in my state), and petition for guardianship. Your state may have other remedies. You need a competent lawyer for this and also preparing your last will and testament. You need to consider to whom your life insurance proceeds would go in the event of your death: the father of this child or someone else? So, you may need a trust. The peace of mind is worth the costs.

This situation should be handled by the Courts or it will bite you some years from now.
