The owner of my house stopped paying his mortgage and the bank is foreclosing on the house. I stopped paying rent about 5 months ago. The owner of the house has just now demanded rent from us and said that we have 24 hours to pay or he will come back with a cop and evict us. From what I have read, he cannot do this. We also do not have a written lease with this man. He bought the house from a man that we did have a written lease with, but that lease ended over a year ago and we never signed a lease with the man who is now trying to evict us. What rights does he have and what rights do I have as the renter?

You will have to move anyway since the bank foreclosure will end your lease. You have been living there on a month to month lease with all the same verbage of the last lease, just month to month. He can evict you, especially since you haven't paid rent for so long, but the process takes at least a month.
