View Full Version : 1099-MISC for engineering design services

I have an LLC that performed engineering design work and consultation for another company and received form 1099-MISC from them for the services in which box 7 is the amount paid.
While they did include the EIN for the LLC, they also included my SSN. From what I have read of the requirements this form should not have been sent, or am I wrong?

A LLC is NOT a corporation, for the Form 1099-MISC should have been sent.

Remember that the LLC is a legal entity, NOT a tax entity.

Was the LLC established on a sole proprietorship, a partnershi, or a corporation (S or C)?

If it was established on a sole proprietorship, it does not matter if they listed your SSN. YOU still have to pay the taxes.

Thanks for the answer.
The LLC was started as a corporation.
The payments were made out to the LLC and deposited in the LLC account as the company has expenses associated with the engineering design, analysis and testing of designs. Would rather not be due taxes as the company is new and running in the red for now.

Then contact the company and have them correct the Form 1099.
