I am a college student paying for college, when my car gets taken from me by an ex-boyfriend at the time. He moves out of town and takes MY car that I was paying on. To make a long story short I bought the car Dec. of 2005 and the last payment I made on the car was in May of 2006. I got behind on my notes and told them the situation. The car was to be reposessed but I did not have it. I attended college so I was rarely at the address the auto lenders had, so when I got summoned to court over the car, I missed my court date. The attorneys of the auto lenders sent me a letter saying I owe twice the value of the car. What should I do, now that I got a call from an impound saying where it is?:confused: :(

I got a little confused in the references to your boyfriend and the timeline. You have not made a payment since May of 2006, and the car was recently repossessed, or not? You were sued; did you receive a copy of the suit? And someone is looking for the car?

My ex-boyfriend used me for my car and he left with it in April 2006. I tried everything to get it back and I was really liking him at that time. I got it in 2005 and made last payment in May 2006. They tried to repo the car but they could not go out of town to repo it. Up until now I have just discovered the car is in an impound in another state. I have been in the process of trying to get another car but it is hard to get an auto dealer to get me a car loan because of that one I defaulted on.

When someone steals your car, you CALL THE POLICE. Now your credit is going to be screwed up just because you were "really liking him." Next time, think with your head and not your heart.

Well I called the Police and they did not see the car anywhere in Tenn. I do not know where he could have been then, so I gave up the search and tried to pay for the car since my mother gave me one of hers. But I did not get a paper saying I was sued. I just got a call from my mother who said a police came to summons me to court but would not disclose of what it was about, she talked to them and told them I was attending school in Chattanooga, but I guess they put a judgement on it then.

There should have been something in your contract about the terms and conditions if your vehicle is stolen. There should also be a police report showing that you called the car in as stolen. Get a copy of the police report and send it to the attorney for the lender.

Okay. Should I try to pay to get the car out of the imound and turn it in to them?

That part's tricky. Even if you turn it in, you're going to have late fees, interest, attorneys fees, etc. so you're still going to owe them a lot of money. They can get the car out of the impound if they really want to, but if they don't know where it is, I'd leave it at that.

I do nor know what they have filed for the car. All I know is that I sold my old car to put a down payment on a car from a dealership and they said I have a car loan on there so they would ask for a co-signer which I do not have. It may not be a judgement or repossession, but if you look at my credit report it shows 60 days late on that car loan.
