View Full Version : Drug tests for unsupervised probationer?

I was recently sentenced to 1 year unsupervised probation in the state of West Virginia. I was told that I would be given a date to go to the probation office to start my probation and receive some type of assessment they said. I'm still waiting for the date to go and report, but I was wondering if I would be drug tested while on unsupervised probation. Thanks for your help!

Hello Matty:

Unsupervised means you don't have to report. If you don't have to report how are they going to test you? The answer is, they're not.

You have a date to report, so there is some supervison, at the time you go in and see them, yes of course they can drug test you.

If you are unsupervised you will not be going in, thus no tests.

Well I know that I'm not going to be at risk for a drug test throughout the 12 month period, but they said that when I report for the first time, to begin my sentence, that I will have some kind of "assessment"(thats what the judge called it) to begin the unsupervised probation...

Im in the same boat as you right now I can't figure it out, just as soon as the judge handed down the same thing I went to adult probation and filled out the forms. I went in the back and they went over it with me no test but said I had to come back? Im like what the heck I'm worried about the same thing that would be a ***** to think I was home free and they spring some bull**** on me.

Sorry to disillusion you but you are "not home free" anytime when you are on probation - supervised or unsupervised. You need to remember when on unsupervised probation you are "on your honor" not to get into any more trouble AND not do alcohol or drugs. So the only way to "beat" them is not do any drugs or drink. Because they CAN come back and spring BS on you when you least expect it.
