View Full Version : Breaking Apartment Lease in Phoenix, Arizona

Hello and thank you for reading in advance. My partner and I have lived in the same apartment complex for the past 2 years. We have been saving up, and are currently building a house. We signed the house contract in September. Unfortunately at that time, we also signed a 6 month lease for the apartment complex thinking that the house would be done at this time. Well the house is about done, and we are set to close on January 29th. Our dillema is we informed the complex, and they honestly are not being very friendly. I know that in the past, apartment complexes woudl let you out of a lease, if you were buying a house. I do not believe this is the case anymore. basically the apartment complex told us they will charge us for all of the "concessions" that were made (which wasn't that much as we were just dealing with a 6 month lease), and for the rent up to May. We are working at getting the apartment at tip top shape for when we leave, hopefully they will get it rented out again very quickly. We also have complained and documented when we complained against our upstairs neighbor, who walks/stomps/runs around her apartment at all hours of the day and night. I do not believe this person sleeps, as she is quite disruptive. Also, she has a dog, who when the dog runs around, sounds like a galloping pony. We were told quite clearly that dogs are not allowed in the apartment units, only in the condo units they provide in the front of the complex. My questions are: Is there anything I can do as far as using the noisy rude neighbor as part of the reason we are leaving? Also, about her dog situation being part of the noise when they apartments are not in fact supposed to have dogs? If they can get someone in the apartment soon, could we get away from being charged rent for the months that the new tenant will be paying the rent? Just seems kind of redundant for us to pay rent for March and April, when a brand new tenant in the apartment will be payinmg their rent for the same timeframe. Also, is there a way to ensure that the complex is activly searching for prospective tenants, and not just taking their "sweet time" because they know that the money is coming in anyways? Why should a landlord let you out of a lease because you are buying a house? They still get shafted. They DO have to make a good faith effort to re rent the unit. But otherwise you are responsible for the rent untilthe lease expires. If you signed a new lease in Sept, why does it go to April? Shouldn't it be up in March? How much notice does the lease require? If its only 30 days, then you should only owe for 2 months at most?

In most states they have to advertise the apartment ( or complex)
There are a few states where they don't have to make any attempts at all. I do believe in your state they have to.

You are liable for the full rent till it is rented. Some landlords are nicer than others, about letting people out
