My husband is verbally and physcially abusive to me and our 8 year old daughter. We have a home that is in my name only and I live in Georgia. I want a divorce without having to buy him out or sell my home. My daughter and I have no where else to go and he hasn't worked most of the marriage. I currently pay all of the bills and I am taking out a restraining order against him. Can I save my home from my husband?

Hi this part has nothing to do with the house But, how long have you been married?

Now you said that the house is "only" in your name... Then in this case I believe he has no legal rights what so ever to your home. I am not an expert so I would make sure about this but I am pretty sure you can kick his butt out with no worries plus if you are filing a restraining order he will have to move out regardless. You should consult an attorney to handle your divorce. I think you have a good chance of keeping the house, especially if you have an attorney handling your case.

More than likely, yes. He has a claim for equitable (fair) division of property. If he baby-sat, while you worked, you may have a problem. If he fished, while you worked, you may be in very good shape.

Okay first of all I just want to say I am sorry for what you are going through. I feel really bad that you are having to for through this. Two sisters of mine were both in physically and verbally abusive relationships. I know sort of like what you are going through! Not totally.

Also. The fact that the house is in your name most likely you will get it. But like one other person said he can ask for fair division of the property.

You also need to get a restraining order and get him OUT OF THE HOUSE!! If you do not have anywhere else to stay you could stay in a woman's shelter until he gets out. But you need to do that. I am very sorry about what you are going through.
