I've been coming here for like the past week cause my friend has been charged with theft under 5000.( this is in Canada). And is a First time offender as well
Now there is no way that he can go to jail right. I mean he has a lawyer and everything, is in school has a band. Right he'll be slapped with like community service.

Please help cause I want to make sure my optimistic outlook on things right now isn't a total bust thanks!

While the Canadian Criminal Code allows for a judge to sentence someone convicted of Theft Under to a jail term of no more than 2 years (assuming your friend is 18 or older), it is unlikely that he will receive a jail term as a first time offender. With my experience working at a probation office, I would guess he would get a term of probation, possibly including community service.

If he is under 18, then as a first time offender for a property offence, he will not receive any jail time.

Oh yea forgot to mention he was over 18

- First time offender.
- Theft UNDER 5000.
- Hired a lawyer.

He won't get jail time. Odds are the lawyer will be referring him to a diversion where he would have to pay a charitable donation, or small amount of community service. Once this is completed, charges would be dropped.

Since a lawyer has been hired, no need to worry about anything at all.
