View Full Version : Trying to regain custody of my boys

Okay, so a little over a year ago, my ex husband took advantage of a difficult time in my life and took my two little boys from me. I was not working at the time and living in my parents house with my two children. I had to go into court to fight him without an attorney and I lost. Needless to say, this has torn me apart and my children. I was the only parent that they had known for the first 4 years of their lives. I take advantage of all the time that my ex husband will allow me to see my boys, in order to make sure that they never feel like I don't want them or that I abandoned them. Now I have gotten my life back in order and I am ready to go back into court and fight him to regain custody. My problem is that my ex husband is now making life difficult for both my children and I. He no longer lets me talk to them on the telephone and when I pick them up or drop them off, he always tries to start fights with me in front of my children. I try to walk away and he will follow me to my car yelling and screaming at me. This last time he even went so far as to raise his hand at me. I still cannot afford an attorney, but I am working on it, but I really feel like I need to get my kids out of that environment as soon as possible. What can I do? Is it going to be harder for me to regain custody if I have moved out of state since the last custody battle?

Most attorneys give free consulations. What you need to do is get all the ducks in a row. Keep paperwork, record conversations between you and him, write in a journal, have your kids write in a journal. If the custody has already ended, what you can do is move it to the state you are in. You can fight for custody in the state you are in even if the legal parent is in a different state. It gets easier if you have everything and I mean EVERYTHING documented. What he is doing is alienating your rights. Don't stoop to his level and keep everything quiet. If you are going to hit him... hit him hard legally. There are also a lot of attorneys that work through payment plans. Good luck
