Can someone tell me the steps I need to take to get my half of my ex-husbands retirement and 401K? I thought my lawyer would know how to get it but she says the company is supposed to send her the forms so she can word it right, but the company hasn't done so yet. What has to be done in step form so I can see to this? Thank you so much for any consideration on this question.

The starting point is the decree of divorce and whether the 401k was awarded to you by the court or by agreement with your husband. The 401k is administered by some entity; you will need to contact it and request a copy of the plan or rules setting forth how the plan is administered. It sounds as though the lawyer is on the right path, although you didn't say how long this has been going on.

Well it seems she is doing right then. That is what she has done and the company isn't sending the forms. They act nice about it but do not come forth. This has been going on for 4 months. Thank you for answering my question.

Do you have copies of your attorney's letters? And responses? Four months may be pussyfooting.

No I don't but I know that they have gotten it at the company. I know the lady in charge of it there and she keeps saying she will do it but hasn't. This has gone on for about a week. In the meantime I have looked on the internet and found this company who deals in nothing but Quadro's and I may get them to get it. It seems they specialize in writing the forms to get it. Anyway, I am just questioning the whole thing right now. I know lawyers have to eat but I have to eat also. Thanks for responding to my questions.
