View Full Version : Tenants rights in a foreclosure In Virginia

I entered into a lease in Nov with option to buy in 12 months. I was just told today that the house is being auctioned on Jan 9(which is tommorrow) What are my rights. Basically I need to know how long do I have before I have to move if no one buys the house at auction and it goes to the bank? Please answer ASAP

I suggest you show up at the auction with your contract showing your option to buy. You might be able to delay the auction because your option will take precendence. You can then make an offer to owner. Since he is about to lose the proper anyway, he may be willing to just let you assume the mortgage.

If you have an attorney, have them go to the auction with you, or file a stay in court first thing in the AM.

If the auction does go off and someone buys it or the lender takes it over, them you will have very little time to move.

You can get served a notice to move between 3 and 30 days, you can of course ask for a court hearing, and require a court eviction.

Basically you have no rights what so ever after the house sales. So you need to start looking seroiusly for somewhere to move to.
