I have got a question on H4 to L1 Visa conversion...

I am on H1 status and my wife is on H4 status. She used to work in india prior to coming to US and in US she holds a H4 status.

She is on her trip to india and the company in which she was working prior to coming US has showed interest to apply for her L1 VISA.


Is it possible to apply for L1 Visa for her and if YES, does she need to go to US consulate in india to get L1 visa stamped .

If suppose her L1 visa gets approved, will her H4 Status gets erased and can she come on L1 Visa.

Also if her L1 visa gets rejected, can she enter US with valid H4 Visa.


What if the company applies for her L1 visa and she comes to US on h4 and converts her H4 to L1 . Does she still needs to go for stamping or not?

Appreciate if I could get the answer which would in turn relieve me from tension.

Hello varthi

Your first question is if you could process your L1 for your wife if she is on H4 - The first prerequiste for L1 transfer is that the person should be working for an overseas company for at least 2 years , if you are able to prove this , all the things will follow . H4 status will automatically be cancelled once you get L1 stamped and L1 stapning has to be done in the country of your employement where you have been with the company for 2 or more years .
