My daughter just found out that she is pregnant. The father of the child just passed away. They were not married at the time of his death. What legal rights does his parents have? Can he be listed as of the father on the birth certificate? We live in Florida

No he can't!! And what earthly reason would he want to be?? His parents have NO rights. That doesn't mean they shouldn't be included in their grandchild's life. It just means they can't make legal demands to do so, that's all.

Some states have passed grandparents visitation laws. You should be able to locate Florida's online. There is an issue as to paternity. My guess is that either your daughter or the father's parents can file a petition to determine paternity and request some type of visitation. If the father had life insurance payable to his estate, or other assets, your daughter may want to pursue a claim against the estate.

I am going through the same thing my children's father was murdered in June and our third baby was born in June I put his info on her certificate all you need is his death certificate and letter of permission notarized by his parents.
