How do you evict someone living in your house that does not have a rental agreement.

To cover your rear-end. Give them a 30 day written notice to vacate.

If they do not pay any rent to you with say by a check or cash and you do not give them a receipt then guess what... you can just tell them to leave. If they don't leave, then guess what... depending what state you live in you can't evict them! I had the same problem once as the person did not pay rent. Long story of how I got rid of them without going to court or resorting to violence. If they pay rent that's a different story. Yes, you can evict a person who pays rent.

Hello hate:
You have to evict them according to your states landlord tenant laws. We have copies right here at the top of the real estate page on a "sticky note".
You could start with a 30 day notice.

A large amount of renters do not have a written agreement, so they are on a verbal rental agreement, if they pay monthly and you wish just to get them out, you give them a 30 day notice, If they are not paying rent, you can give less according to your state law. If they still don't move after the notice, you take them to court to evict them though the courts.
