I know someone who owes 16,000 in a crdit card, hes currently not able to work, due to stroke which left him limping on one side. He had a triple bypass surgery 2 years ago. He has tried to work and no one will hire or keep him due to these health problems because of liability reasons.
Anyway he has been sent a summons to appear in court, my question is what are they going to do? He can't work nobody will hire him, but yet he still owes. He has paid this amount down to this amount of 16,000.
I just want to know what will they do in this case. He has currently applied for diability before all this was done.
Any answers?:(

Never. Debtor's prison ceased to exist in the 19th century. The only time someone might be jailed for debt if it was obtained fraudently.

P.S. Please don't type in all caps.

Hello me:

We don't have a debtors prison in this country.

If he doesn't have money, they can't collect any. They can't garnish his disability if he wins it. He's what we call judgment proof. What should he do? NOTHING. If he can pay, he should keep paying. It IS his debt. But, if it's a choice between this bill and lunch, he should choose lunch.
