View Full Version : Selling your home when co-signer is not able to be found or is not willing to sell.

My mother and my step-father recently refinanced on the home. Both of their names are on the deed. At one time my step-father was living in the household. Now he is not and has not lived here for 2 years. He is not contributing financially to the mortgage at all. Now that the interest rate has flipped, my mother can not afford the mortgage. My mother does not want her credit to be jeopardized by allowing the house to go into foreclosure. We are now trying to put the house up for sell, but we are unable to get cooperation from my step-father. At times we can not reach him and we do not even know where he lives. He has all the leverage, but is not contributing to payments and does not live in the household. What options do we have to get out of this home w/o jeopardizing my mother's credit. They are not married and we live in California.

Are they married? If so, she needs to file for divorce or legal separation. Ownership of property is one of the issues involved in the case.

Hi which country are you from/? I had a similar problem in the UK I wanted to remortgage but my ex would not agree to it so I went to court and spoke to the judge Sorted!!
