View Full Version : Landlord has been ordered to pay - what is my next step?

I live in Ontario, Canada and have been in and out of the Landlord/Tenency Hearings over the last several months. Through these hearings, I have been granted the order and my previous Landlord has been ordered to pay me approximately $3500.00. The timeframe given to the Landlord to pay this amount has passed. I know that I must try to enforce this order, but I am unsure how to do so. What is my next step? Do I now need to bring the Landlord to Small Claims court to issue a garnishment?

Notify the courts that he has not paid. Since a judge has issued an order and he has violated it, I suspect it will be up to the courts now.

In the US you would need to find the landlord's bank account (check your cancelled checks) and then go back the court and request a granishment order.

I would suggest serving it on the bank a day or so after rent collection day.
