View Full Version : Tax Deed sale with No Probate?

We are losing our House due to non- payment of taxes. There are 5 Children listed on the Will, only one of which lives here in Florida. We have been "revolving" the tax paymenst between all of the children.
Mom died in 1992, and no Probate was filed. The last two sisters who were responsible to pay these taxes did not. We are now informed the property will go up for Public auction as of 1/16/08.
The will had stated 5 childre. We have not done anyhting, because 1) two of us are unablr to be founf 2) no-one wantde to come up with the 2500 to put it thriugh Probate to begin with.
I have been living here for the 12 yaers, and it seems I have no re-course? All the money I have used for repairs, ect..?
If the property still has not gone thorught, who gets the moeny for the Sale...Since two hiers cannot be found?
Frankly...What are my Options?

Hello Randall:

The house has got to be worth a great deal more than the taxes owed. If it goes up for auction, somebody is going to steal your house. There WON'T BE ANY PROCEEDS. Somebody will buy it for the amount that is owed. The government will get it all.

So, I would get a loan and pay the taxes.

If I was you I would get a friend to buy the home for you.

And as excon said, if the taxes owed are 1000 dollars, the house may sell for 1200 or something but normally I get the houses I buy for never any more than double the taxes. If there is any thing over, the money is issued to the owner of thehome as recorded in the tax department, in your case it would be the estate of the family member who died.

This is long due to go to probate, You could pay the taxes and use it as a claim against the estate ( the estate is suppose to be paying the taxes anyway at this pont)
