My husband has an x-girlfriend that he dated before meeting me. The girl got pregnant separated from the military and went to go live with her girlfriend ( the x-girlfriend is bisexual) She told my now husband that the baby wasn't his and she didn't want anything to with him. Well, when she found out that he was getting married he started to receive threatening e-mails telling him that he needed to send money and all of this stuff. He has been ignoring it. Well after the x-girlfriend found out that we were having a baby of our own. The e- started again and she is trying to say that the state of texas( where she lives with her girlfriend) is trying to track us down to make my husband pay child support. We live in Florida. Can a court order you to pay child support if there is no proof that you are the father and you are not on the birth certificate. My husband wants nothing to do with her or her child and has his own family to provide for. Is there anyway that by chance he is the sperm donor that he can give up his paternity rights and not have to pay !child support? PLEASE HELP

If he is, he is. If they do, they do. If it will happen, there is no way to know, but it could.

Pretty much all you can do is wait and see if you are contacted about the situation.

If you don't want to hear from her, then why not block her from sending emails?

Is there some reason that contact is still taking place? If the child is his, does he plan to be responsible?

I personally would want to know either way through DNA test if I had a rumored child out there somewhere.

He wants nothing to do with her, I can understand. But this is an innocent child. Why punish the child for the parent's mistakes?

Now, he needs to take a paternity test before sending one red cent. If the child is his, he needs to be responsible and take care of the life he created.

They can not make him pay if he challenges the court hearing ( go to court) and demand a DNA test. If he is proved the father, he can be required to pay child support many times back to the time of birth, But he can get visitation of the child.

The amount of child support will be based on many factors including his earnings and state rules.

Giving up any rights ( even if the court would allow it) does not stop child support, he would have to pay but could just not get any visits.

And of course he was a boyfriend and lover, not a one night stand and not just a sperm donor, he should have demanded a DNA test from the beginning and if the father got visits.

A DNA test will determine paternity, and if he is the father he pays. The rest is up to the adults to work out, if they are mature enough to set aside the crap, and work in the best interest of the child.

Yes, it can happen... there is a case on here that is similar to yours... I will try to dig it up.

I will add that men or women that donate sperm/eggs in this world should have to pay up. They should help nurture the child that was brought into this world... but if they lack the ability or will to be a good parent. The least they should do is help pay to feed, house... the child.
