View Full Version : Banishing my sons biolagical fathers rights

I'm currently living in Virginia Beach Virginia. I moved from Pennsylvania on July 14th 2007. I gave birth to my son on March 8th 2007 he is currently 9 months old. The last time his father saw him was when he was 4 months old. At that time things between his father and I were getting bad, my son was staying with my aunt for a week I would go over to see him and spend the majority of my time with my son and family. His father doesn't pay child support because he has 2 other kids to his ex-wife and he is court ordered to pay and he is behind almost $600.00. I felt being the better person knowing that he couldn't afford another child support payment I told him that I was going to take my son and move to Virginia to be with my family. I felt that doing this would make him relize that I wasn't subjecting my son or I to his violent behavior ever again. He is mentally and physically not capable of taking care of my son and I am. I have an idea where he lives but I choose not to talk to him because he is still in a lot of disolusion about me coming back to him. He threatens his life almost every time I was around him or talked to him on the phone. I had lost a great deal with him my truck was reposessed we had no electric or heat so it was in my best interest of my son to go and stay with my family and that's what I did. I have many people behind me that support whatever I need to do to keep this man away from my son. I know he will put up a fight when I decide to banish his rights as a father he calls but my mother talks to him because I have nothing to say to him like I said he doesn't pay child support for my 9 month old son and he hasn't seen him since he was 4 months old I feel as of best interest of my son that he has no contact with my son or I. I also want to change my sons last name to mine the only reason I placed my sons name as his fathers last name was because I was fearfull for what might of happened. Before I moved to Virginia he was never home to even be around us long enough to care. If there is somebody that can help me figure out what to do I would appreciate it very much so. Also I would like to add that I spoke to a lawyer through the state of Pennsylvania after I moved down here and he recommended that I didn't go through the court system because his father would be granted visitations and if I'm in Virginia Beach and he is in either Flordia or Ohio when he isn't traveling with the CARNAVAL that he works for in it off season as he likes to refer it as he basicily told me that he knows that I can take care of my son better than what he can and that he wouldn't try anything. On the other hand he lies constantly about everything yeah he wants to see my son but I feel that its best that he doesn't have anything to do with him. He gave me crap when I went into the hospital to have my son and he gave me crap because of the name I chose for my son. This is a man that only feels that the world should bow down and kiss his feet well and because of that I MOVED AWAY FROM HIM BECAUSE I Don't NEED OR WANT HIM EVER AGAIN. He would like to have supervisied visitis with my son with a cop present but I would still have to go through with the court system for such documents he hasn't seen him since he was 4 months old and I plan to keep it that way the man doesn't diserve to have anymore kids he can't even afford the 2 he has to his ex wife let alone my son. I don't want to get into anymore of the problms that I encountered with this man so I hope you get what I'm trying to say here and understand how I feel because men like his father that don't give a excuse my french but they don't care about anything but themselves only need themselves his ex wife agrees with me on that and she is even looking into things like I am anymore questions please feel free to ask I'm very happy to answer any of them

You don't have the right or the ability to banish anyone's rights,

Do you have a child custody agreement in court, if not that is your first start. If the father wants visits unless you can prove he is a danger to the child, he will get his rights to visit the child.

I believe that you should do what is right for your child, but in the same respect you can't banish someone's rights. You can get sole custody over the child and get supervised visitation rights. And of course the father is going to fight you about it, it's not right that he doesn't pay child support and that should also be something that is settled in court. Well I hoped this helped a little bit.
