View Full Version : Sold debt lawsuit after statute of limitations

We began receiving mail from attorneys and mediation companies offering to help us a with a lawsuit. We weren't aware of any lawsuit, and have not received a summons or notification of any kind.

The case number and such was listed on the legal help solicitations and it turns out it was a debt that had been long ago written off, as it was no longer verifiable with the original creditor, and hadn't even been showing up on our credit report (we had gone through several mortgage approval processes in the intervening years and know what was on there) until a collection agency bought the debt last year. Now all the sudden it is back on our report.

The last activity was over 6 years ago and incurred in Nevada, so past the SoL for that state.

If/when I receive a summons what should we do to get it dismissed or how do we answer it? Do we need an attorney or can we just show up?
