View Full Version : Subletter's rights to exclusive use and possession?

I'm in California. I'm subletting a bedroom in a 2 bed-2bath apartment off my roommate. My name is not on the lease. I pay 1/2 of utilities and rent. My roommate has recently decided not to share any of the space or fixtures in the living room, dining room, my bathroom, closets, bookcase, etc. I am allowed to use the kitchen, but am only allowed to have one of 8 cabinets for my food/plates.

I've sublet apartments in several states and this is the first time EVER that I've been restricted to anything less than 50-50 (or proportional) use and possession.

Isn't this roommate renting me a 50% share of his right to exclusive use and possession? Or am I just stuck with the world's stingiest roommate?

Calidreamer, you should have something in writing if you are paying half the rent and half utilities. There are sublet agreements. If nothing is in writing, then I can see why your roommate is walking all over you! Demand a signed agreement or move out.
