View Full Version : I sold my home, how do I get the tenant out?

I have a buyer for my rental in Florida who wishes to move in. How do I get the current tenant out? What is the time frame for notice from the landlord(me)? Need answer soon.

If there's no lease you need to give them the span of one rental period (aeek if they pay weekly rent, a monthif they pay monthly rent) notice I believe, to find a new place and move out.I would suggest 30 das, it takesa while to move and find a new place.

If there is a lease and they are paying rent and not breaking any part of the lease, you cannot make them leave until the lease is up, I believe.

If you already sold it then its no longer your responibility. The buyer knew there was a tenant so they have to deal with it.

If you haven't closed yet, it depends on the terms of the lease.

The tenant is on a month to month lease, and I have already had problems collecting from this person. Every month there is an excuse that she does not have all the rent. I looked up this girls record and she has had several injunctions in court records. One of them involving the condemnation of a former place she rented. She has threatened me with doing the same thing, she also never did a walk through with me. And this month her electric bill was $400.00 and she expected me to pay half of it. HELP!:mad:

Hello lady:

You'll need to evict her pursuant to Florida landlord/tenant laws. We have a copy right here at the top of this page for your perusal.

It MAY take several weeks or longer. I don't know when your closing is scheduled.

If HER electric bill is in YOUR name, guess who's going to pay it?

Yeah never put anyone else's bill in your name unless it's a spouse and your money is connected to each others' anyway.

The electric bill is her name. And actually the property is my sister's, she is signing it over to me. No sale involved, just a quit claim deed. But I do plan on moving in. Just want to know the legalities of removing this woman.

Hello again, lady:

I'd first try just to give her a 30 day written notice to vacate. That's cheaper than filing suit. Maybe she'll go. If not, then you'll need to evict her.

Who cares what bills she WANTS you to pay? You're not going to pay 'em, are you?

Actually, the house is my sister's and she is giving it to me, by way of a quit claim deed. I do plan on moving in. I listened to a conversation between my sister and the tenant. She is a piece of work, trying to justify not being responsible for the electric. The tenant has only been there since October of this year and every month so far, has been an excuse not to pay the full rent. I am a little meaner that my sister.
