View Full Version : Being unmarried and getting boyfriend off title of house

Last year me and my boyfriend who have lived together for 2 yrs refinanced the house that me and my son had lived in for the last 5 yrs. We are splitting up, so how do I go about getting his name off the title of the house, and if I would have to refinance to get him off he has threatened to not sign off, so I wouldn't be able to refinance and has said he will not sell. At that point would I have to go to court to make him either buy my half out or to make him sell the house so we would both be off the house? Thanks for any help you can give me!

You need to refinance again. However, I don't know if you can FORCE him to refinance if he doesn't want to.

I think you need to visit a very good lawyer.

You need a real estate atty. There are ways where you can force a sale if you are co-owners of a property. But once he's on the title, you will need to buy him out to get him off. Or have him buy you out and move.

He owns 1/2 of the house, there is no way to just get him off if he will not agree. You may have to actually sell the house but he will get part of the profit from the sale. You also may have to offer to pay him to get him to sign over his share. Remembre after you added him to it, he is part owner and this is not "YOUR" house, but "both of your" house by law
