I am currently renting a property which I signed initially for a fixed term of six months, this has since expired and it now runs on a periodic contact, month to month.could you tell me how much notice must I give to end the tenancy, my land lord says imust give at least three months notice, but I have been advised again that I only have give one months notice, my original tenancy agreement states that I must give at least six months notice. Who is right,, plus I haven't signed a new agreement so has the initial tenancy contract expired?? :confused: :

Your original contract(lease)has expired, so you are on a month to month tenancy. You are required to give 30 days notice, I would think, no more. That is always the case on the court television shows, so that must be the case in a majority of the states in the US.

Remember each can give the notice, tenant or landlord.

Technically, when the lease expires, all the terms of it except the expiration date remain in force. So, I am sorry to say that it sounds almost like you would be required to give at least 6 months notice. Which seems insane to me. Are you sure that's what your lease said? After all, based on that, you would have had to give your notice that you were moving out on the day that you moved in!

I tend to agree with Froggy, but I have doubts that the lease actually says you need to give 6 months notice. Can you show us the clause that says that?
