View Full Version : May need to force the sell of house via partition suit

Case description: After Florida probate, my stepson owns 25% of house and I owe 75%. For round numbers, the house is worth maybe $200,000.
The stepson has lived in it since 1992. When I told him in July '07 that I needed to liquidate my portion, he quit paying me rent and refuses to discuss any reasonable offers to buy me out and says he doesn't want to sell it. He doesn't have any savings and I can't believe a bank would ever give him a mortgage since he has no income verification, etc. I've always paid the property taxes and insurance.

In order to recoup my investment, I guess I need to parition the court to force the sale, I'd have to buy the place, clean/fix it up and then put it on the market to sell.

Any other options?
How much time and money will a partition suit require?
Can I file the action without an attorney? If so, how?

Are partition sale of a house of unmarried couples with little equity a good route to go because both are on the loan and one of the parties will not agree and says they will stay in the house and not pay even it ruins both of our credit scores
