View Full Version : 2 Parents agreeing on relinquishing rights

I have an interesting but probably not too unique situation. I was forced into being a father with a woman that I told had no future with me. I have other children and have taken the honorable approach by paying what is required of me and always offering my time to the child. The mother of the child is so bitter about me seeing someone else that she refuses to now let me see the child. We have done mediation and almost everything imaginable to resolve this but to no avail. We have joint custody but she recently moved to an undisclosed location and switched the day care of the child without telling me. She has formally stated to me that she will not communicate with me by having me contact her mother. I refused to comply and have not seen my child in months. The mother and I do not get along. She didn't even invite me to the child's 2nd birthday! Making a long story short, after a recent mediation, she stated that she wants me to relinquish parental rights and that she didn't want a dime from me so long as she didn't have to see me again. If I were to agree to this and if written up formally, would that free me of the child support obligation?

Not likely. Even if you both agree to this the court is not likely to grant it. Termination of parental rights is a serious business and most courts will not grant it unless there is someone waiting to adopt or the parent pesents a danger to the child.

What you need to do is go back to the court and have here served with an order to comply with the court ordered custody and visitation. Based on what you have told us, you might even be able to get primary custody because of her defiance of the court.

I agree with everything Scott said.

The court is going to look at what is in the best interest of the child... and that is to be supported by BOTH parents.

I am in Ohio and was in this situation. I wanted my daughter father to sign over his parental rights to me, he agreed... I went to my attorney and he said even though we both agreed on this issue, by law it couldn't be done unless I had someone willing to adopt my daughter.

I would more focus on holding the mother in contempt of a court order for visitation.
