View Full Version : Breaking up Apartment Lease Early from Florida because of Job Relocation

Hi,

I rented my Apt in Aug 2007, I am on 1 yr Lease, got Lay off start of Nov & searching for jobs, I got some offers out of State & area, which are very good, what r my choices to break the lease.

I called the office and they said I have to give 60 days Notice, or 2 months Rent, Plus 1 month Rent for breaking up the Lease, plus I was given $1000.00 off my 1st Rent, so the total comes to $5035.00. This is just not right, I am out of Job, I have no income coming up, plus I have to move for the job.

Please Advise, what r my legal options.

Actually that sounds about right, fair? Fair is you staying and paying your entire year lease as you promised, doing anything else would not be fair to them would it? They are relying on your promise to pay to budget their bills. So by asking for 3 months rent , that is about as fair as it gets.

Florida is the only state I know of where the landlord does not have to mitigate his damages by re-renting the unit when someone breaks a lease. So by him offering you this buy out deal.. he is doing you a favor. He can, if he wants, just sue you for rent until your lease expires... and I'm sure that is a hellava lot more that what he's asking for now. You signed the contract... your obligated to adhere to its terms.

Also, if you are looking at jobs out of state, see if they want you enough to cover some of those fees. If they want you bad enough, they will.
