My landlord informed us that rent was increasing a few days before August rent was due. One of my roommates was not going to be able to afford this rent increase, so she was forced to move out. The house is in a college town and my other roommates as well as myself are students. Naturally, we want another roommate who's a student. Since most people know where they're living by August, we have still not found another roommate and it's November. My dad talked to the LL into slowly increasing the rent so that we would be given some extra time to find a roommate. The rent is done by the entire house, so the 3 of us are having to cover the extra rent. I have been living here for a year and a half and have never signed a lease. The LL thought he gave me one when I moved in and he swore that he had a signed copy of it but he can't find it because there never was one! That is besides the fact, but he gave us a new lease in August when the rent was supposed to increase. The lease had one girl's name spelled wrong and the girl who moved out's name is still on the lease. We never signed it because we didn't want to get locked into having to pay the extra rent for an entire year if we didn't find another roommate. If we don't find another roommate by January, none of our parents want to continue to pay this increased rent. I have decided to just leave in January. The only problem with this is that the other girls have to leave also, find 2 roommates instead of 1, or pay the extra rent. Since we don't have a signed lease but had a verbal agreement, is it legal for us to move out as long as we give him 30 days notice?

Since you don't have a signed lease, and never had a signed lease, you are a month-to-month tenant. You are required to give at least 30 days written notice of your intent to move out.

Since there is no lease to bind you in, then you don't even have to give 30 days notice. If all of your belongings are gone, then the landlord cannot do anything about it since there is no signed lease.
