Hi I also am having a problem with Sharinn & Lipshie. They have purchased an account from Bally's total fitness that supposedly belonged to me. They put a judgement on my credit report. I was never served, in fact at the date they say they served me I was no longer living in NY. Whenever I call they give me a run around and get very nasty with me over the phone, they don't even want to validate this information. I recently sent them a letter telling them to send me all info that they have to their claim. I don't know what else I should do, I know what they did was illegal but I don't know what to do to prove it. Can someone give me some advice!!

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

File a motion with the court that issued the judgement to Quash the judgement based on improper service. This will allow you to get a new hearing where you can defend against the suit.

If you can prove you were not at the address in NY on the address you alleged to be served you should be able to vacate the judgment; I would have someone pull a copy of any Affidavits of Service to determine if they allege personal service, nail and mail, "sub" (substitute) service -
