I saw a movie a while ago I'm not sure when this movie came out, but I think it had Sean Penn in it. I searched his whole videography and came up with nothing so I could just be mistaken him for someone else. Anways this movie was about this guy who was married and they were trying to adopt a child. His brother was some messed up dude who was being searched for by some "mob"/"gang" type of people. The non-messed up brother had social services or adoption agency coming to look at his house and interview him at the same time these mob/gang people were coming over and killing people with saws and stuff in his garage. They were looking for some money that his brother had stolen and hidden somewhere. This really skinny girl came over to his house and bound him to a chair (I believe in his kitchen) then does some pretty dirty things to him including ing him. Around the end of the movie the messed up brother calls his brother and says something like this: "one day you're gonna be sitting on a beach somewhere with a spare tire wrapped around your waist?"

I'm pretty sure you're thinking of "Thursday (http://imdb.com/title/tt0124901/)" (1997) with Thomas Jane ("The Punisher") who has some physical similarities to Sean Penn. But there was no brother. He was the one that had cleaned up his life. There are the parts where he's tied to the chair and "dirty acts" are performed on him and he and his wife are being visited by a psychologist so they can adopt a child.

Sean Penn is in a movie called "The Game." Michael Douglas is his brother. I haven't seen the movie in a while, so I'm not sure if the movie follows anything but the "brother" part.
